Terms and Conditions of Sale

Bienvenue sur grahamshop (https://grahamshoping.fr). Les présentes Conditions Générales de Vente (CGV) régissent les relations contractuelles entre grahamshop (ci‑après « le Vendeur ») et toute personne physique agissant à des fins qui n’entrent pas dans le cadre de son activité commerciale, industrielle, artisanale ou libérale (ci‑après « le Client »), et souhaitant passer commande via le site grahamshoping.fr. Elles s’appliquent à l’ensemble des ventes de vêtements et accessoires physiques. Definitions
– Product(s): clothing and accessories offered for sale on the website.
– Order: an agreement whereby the Customer accepts the Seller’s offer to purchase a Product.

Purpose and Scope
The purpose of these Terms and Conditions is to define the rights and obligations of the parties in connection with the online sale of physical products (clothing and accessories) on grahamshoping.fr. They apply to all orders placed through the website, within the legal limits applicable to consumers in France and the European Union.

Availability.
Product offers are valid as long as they are displayed on the website, while supplies last. If a product becomes unavailable after an order has been placed, the Customer will be notified as soon as possible and may request that the order be canceled or modified.


Prices Prices are listed in euros (€), inclusive of all taxes (TTC), excluding shipping costs, unless otherwise stated. We reserve the right to change prices at any time, without affecting orders that have already been confirmed.

 Ordering
Ordering Process
The Customer selects the products, adds them to the cart, reviews the order summary, and confirms the order by following the steps provided. The order is final only after payment has been accepted and the Seller has sent a confirmation email containing the order summary.

 Records and Evidence
We store orders and invoices on a reliable and durable medium in accordance with legal requirements. The electronic records stored in the Seller’s systems are considered proof of communications, orders, and payments between the parties.

 Payment
Terms and Conditions
Accepted payment methods: credit card, PayPal, Stripe. Payment is due at the time of order. The Seller uses secure payment solutions (encryption and security protocols). The Seller does not store any banking information, except through authorized payment service providers.


Security Transactions are processed through third-party payment providers (PayPal, Stripe). We may be held liable in the event of a technical failure on the part of the provider, subject to our obligation to provide information and select reliable providers.

Shipping
Areas and delivery times
Shipping areas: France, Europe, Worldwide.
Delivery times: 5 to 10 days maximum worldwide from the date the order is confirmed, provided the preparation time indicated on the product page is met. Delivery times are provided for informational purposes only.


Shipping and Terms Delivery charges are specified during the order summary and billed in addition to the price of the products. The Customer must verify the accuracy of the delivery address; the Seller cannot be held liable for any errors entered by the Customer.

 Receipt and Inspection
The Customer is required to inspect the condition and conformity of the products upon delivery and to report any issues (missing items, damaged packages, or non-conforming products) to the delivery person and the Seller as soon as possible, and no later than 48 hours after receipt, by sending photos and supporting documentation to the Seller.

Right of Withdrawal (Article L221-18 et seq. of the French Consumer Code)
Time Limit and Exercise
In accordance with European and French regulations, the Customer has a period of 14 calendar days from receipt of the item(s) to exercise their right of withdrawal, without having to provide a reason for their decision or pay any penalties (except for return shipping costs, see below).

Effets et remboursement
En cas d’exercice du droit de rétractation, le Vendeur remboursera tous les paiements reçus, y compris les frais de livraison standard (mais pas les frais supplémentaires résultant d’un choix de livraison autre que le mode moins coûteux proposé), au plus tard 14 jours à compter de la date à laquelle le Vendeur est informé de la décision du Client de se rétracter. Le remboursement peut être différé jusqu’à récupération des biens ou jusqu’à fourniture par le Client d’une preuve de l’expédition de ces biens, la date retenue étant celle du premier de ces faits.

Return of Products
Products must be returned in their original condition and packaging, complete with all accessories, instructions, and packaging, and accompanied, if possible, by the invoice. The Customer is liable for any decrease in the value of the products resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the goods. Unless otherwise agreed, return shipping costs are the Customer’s responsibility. In the case of a defective or non-compliant product, see the “Warranties” section.

Exceptions
In accordance with the law, the right of withdrawal does not apply to contracts for: goods made to the consumer’s specifications or clearly personalized; goods that are liable to deteriorate or expire rapidly; sealed goods that cannot be returned for hygiene or health protection reasons once unsealed (e.g., certain personal hygiene items, accessories worn in direct contact with the skin—the Customer is advised to verify the nature of the products). Legal exceptions apply.

Returns and Refunds (Refund Policy)
The refund policy complies with European Union law: refunds will be issued within a maximum of 14 days from the Seller’s receipt of the notice of withdrawal (see above). In the event of a defective or non-conforming product, we offer, at the Customer’s discretion, a refund or an exchange at no additional cost, in accordance with statutory warranties.

Legal Warranties
Conformity Warranty
Products sold are covered by the legal warranty of conformity (Articles L217-4 et seq. of the French Consumer Code). In the event of a lack of conformity, the Customer may choose between repair or replacement of the item, provided that the costs are not disproportionate to the subject matter of the contract.

Warranty Against Hidden Defects
The Customer is also covered by the statutory warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code. The Customer may return the item or have the defect documented and request a refund or a price reduction in accordance with the law.

 
’s Liability The Seller’s liability is limited to the obligations set forth in these Terms and Conditions and by law. The Seller shall not be held liable for any consequential damages arising from the purchase of the products. In the event of force majeure, obligations shall be suspended for the duration of the event.

 Disputes and Governing Law

These Terms and Conditions are governed by French law. For disputes with a consumer domiciled in France, the applicable rules of territorial jurisdiction apply.

Mediation
In the event of a complaint, the Customer is invited to contact the Seller to reach an amicable resolution. If no agreement is reached, the Customer may refer the matter to the Consumer Ombudsman. Useful information:

Force majeure
Les obligations de ORIVANASHOP LTD peut etre suspendues en cas d’événement indépendant de sa volonté, constitutif de force majeure (grève, catastrophe naturelle, incendie, pandémie, blocage des transports, etc.). Si l’empêchement dépasse 30 jours, chaque partie pourra procéder à l’annulation de la commande sans indemnité.

Changes to the Terms and Conditions of
The Seller reserves the right to amend and modify these Terms and Conditions. The applicable Terms and Conditions are those in effect on the date of the order.

 Miscellaneous
Partial Invalidity
If one or more provisions of these Terms and Conditions are deemed invalid or declared as such pursuant to a law, regulation, or a final decision by a competent court, the remaining provisions shall remain in full force and effect.

Evidence
